DVA GPT ("the Service") is an AI-powered content generation platform provided by Digital Vibes Asia Sdn Bhd ("DVA", "we", "us", "our"). The Service provides pre-built templates and workflows that utilize large language models (LLMs) to assist with business content creation.

The Service is designed as a productivity tool to assist users in creating drafts and content. It is not intended to replace professional judgment, expertise, or specialized services including but not limited to legal advice, medical guidance, financial planning, or other professional consultations.

2.1 Accuracy Not Guaranteed: AI-generated content may contain factual errors, outdated information, biases, or hallucinations (fabricated information presented as fact). We make no warranties regarding the accuracy, completeness, or reliability of any AI-generated output.

2.2 Human Review Required: You are solely responsible for reviewing, editing, and approving all AI-generated content before use. You must not publish, submit, or rely upon any output without first verifying its accuracy and appropriateness.

2.3 No Professional Substitute: The Service does not provide and should not be used as a substitute for:

• Legal advice or legal document drafting
• Medical or health-related guidance
• Financial, tax, or investment advice
• Engineering or safety-critical applications
• Any other professional services requiring licensed expertise

2.4 Context Limitations: AI models may not understand nuanced context, cultural sensitivities, or industry-specific requirements. You must ensure outputs are appropriate for your specific use case and jurisdiction.

You agree not to use the Service to:

• Generate illegal, harmful, defamatory, or fraudulent content
• Create content that infringes intellectual property rights
• Produce misleading content intended to deceive others
• Generate content that promotes discrimination, hate speech, or violence
• Create malicious code, malware, or harmful technical content
• Circumvent AI safety measures or content filters
• Impersonate individuals or organizations without authorization
• Violate any applicable laws or regulations

We reserve the right to suspend or terminate access for users who violate these policies.

5.1 Your Content: You retain ownership of any original content you input into the Service. You grant us a limited license to process your inputs solely for the purpose of providing the Service.

5.2 AI Outputs: AI-generated outputs may be used by you for your business purposes. However, you acknowledge that:

• Similar outputs may be generated for other users with similar inputs
• AI outputs may not be eligible for copyright protection in some jurisdictions
• Outputs may inadvertently resemble existing copyrighted works

5.3 Our Platform: DVA GPT, including our templates, prompts, interface design, and branding, remains the intellectual property of Digital Vibes Asia Sdn Bhd.

6.1 Service Provided "As Is": The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

6.2 No Liability for AI Outputs: DVA shall not be liable for any damages, losses, or claims arising from:

• Inaccurate, incomplete, or inappropriate AI-generated content
• Decisions made based on AI outputs
• Business losses resulting from reliance on the Service
• Third-party claims related to your use of AI outputs

6.3 Maximum Liability: In no event shall DVA's total liability exceed the amounts paid by you for the Service during the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless DVA and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

• Your use of the Service or AI-generated content
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you publish or distribute that was generated using the Service

8.1 Availability: We strive for high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

8.2 AI Model Changes: The underlying AI models may be updated or changed without notice. This may result in different outputs for the same inputs over time.

8.3 Feature Modifications: We reserve the right to modify, suspend, or discontinue any features of the Service at any time.

These Terms shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Malaysia.
